his fibre bumper cracked and demand $ for repair else he will claim against the insurance. i am thinking, should pay him $ or fight against his claim? any case to win against his claim?

my dad's cab was stationary as he was alighting passenger. while his door was open, a bmw came and hit its bumper against the edge of the cab's door... -
Money involved... I can't tell u much. But if happen to me I will try to prvt settle. Usual neg, it's not a straight forward case, she wouldn't want to lose her ncb as well. Knock down to my comfortable price and make sure proper documents are all signed. As for company ins reporting u have to ask the other guys, I have never reported before. She want $800, if sucessfully claim against her, guarantee she lose much more than that.

yes, driver door. was on a 2 lane road. bmw overtook and hit his bumper against the edge of the door.. -
To my expirence...when u open door & someone hit u.u r in the wrong,the law says u must lookput for vehicle b4 u open the door....is your dad driving a Smart merce ?

No,no,no,no, ts said is driver door. I think most probably pax and the bmw driver are from same gang.The bmw driver have been following the cab for quite sometimes.When pax asked the td to stop, he open the door and run road so ts father also open door want to chase the pax than came the bmw.BANG!!!

Doesn't mean just open door and kena hit means you in the wrong. All depends on circumstances. A taxi (or any other car) has stopped by the side of the road, hazard falshing, no obvious danger to other road users, driver alights to retrieve or do something, then out of now where a car comes and hits the door.
Is the 1st driver in the wrong? the Law never states you can't stop on the side of the road and alight except along zig zag lines.
So all depends on the circumstances. TS or his dad should know best and decide if he is in the wrong or right. If right no need to worry, report. But as Td, must consider the cost, loss of deposit (another 1k until case is resolved). $800 might not too bad a figure considering it's a BMW if the TS's dad is in the wrong.

Who is moving, and who is statonary?
The one who is moving is usually in the wrong against the stationary one.
But is this a moving car against a opening door case?
The BMW cannot avoid the opening door? or
The BMW did not see the already opened door?
I think don't admit error, and fight it out as the BMW driver is poor in judging distance.
