Ok boys , this one it's not me .
I received an email , ask me some serious question i really dunno how to answer .
" Can you advise me what is the likely penalty for causing of death (2) in an accident due to negligence? No alcohol involved.
I know license sure get suspended. What about the likely fine or prison term? Are you aware?
Thank you "
In my entire life as a taxi driver , the worst nightmare i had is to accidentally killed a puppy !
That was at Tuas South Ave 5 a few years back .
The puppy's mummy walk passed , puppy all followed , last one hide under my car .
After i moved , sad story .
Ok back to the thread .
The person that emailed me is a Comfort Sonata relief driver .
He was involved in an accident a few months back , 2 victims was announced dead .
But it was not published on any of the newspapers .
under the law
1. licence sure revoke
2. fine cannot be avoid
3. jail term is part of the it
for 2 fine amount normally few thousands
for 3, please get a good lawyer to fight to reduce as much as possible
( likely days , lawyer will be much clearer to tell ) cos sometime certain action to be done to help the case to get lower jailed term
lastly hoping prosecuter don't ask for longer
let me find out a bit info and reply again

Fatal accident - temporary disqualification until convicted in court, then made permanent. Ban likely 3-5 years for 1st offender.
(There is a difference between suspension and disqualification, suspension is when you go over the points limit, your license is suspended but will be given back. Disqualification means no license)
Sec 66 (1) Road Traffic Act - maximum penalty raised from 2 to 5 years for reckless driving causing death.
If cause of death due to carelessness likely fine from $5000 to $8000. Since 2 victims, likely 2 fines.
If cause due to dangerous driving, likely fine + imprisonment, 6 weeks to 3 months.
If cause to reckless driving, imprisonment of 5 months and upwards.
Factors: If repeat offender, ie; faced a charge of dangerous driving under sec 64 before, higher penalties and jail sentence.
If act was due to total disregard of life or other road users - stiff sentence (reflected in raising of maximum penalty)
If visibility was poor, road condition was wet, driver was driving within speed limit, pedestrians or other party was reckless, a fine and disqualification is the usual tariff.
But if visibility was bad, road wet and driver sped above speed limit, this is aggravating factor, jail term of 6 to 8 months for 1st offender. Since got 2 fatalities, consecutive sentence likely.
It all depends on the circumstances of the case and whether the driver has any previous convictions for dangerous, careless or inconsiderate driving.
A few other things, the case will go before Judge Salina Ishak, she is fairly strict.
Therefore it's best to seek legal advice to mitigate. However doesn't mean must go for the best lawyers, because of the fatalities, this is a losing case so no point fighting the charges. However doesn't mean must go without lawyer.
I recommend a reasonably priced one, no need to go for top notch like Karuppan Chettiar (expert for traffic matters), Subash Anandan etc.
I would recommend Ong Peng Boon of Ong and Co located at Jalan Masjid. He's a diligent enough lawyer to do a mitigation and advise, also to try to lower the charge or change the SOF into something less harsh.
But Judge Salina has many years as the Traffic Court Judge, so her sentences are pretty standard for certain type of cases. Cannot expect leniency but at least with a good mitigation and if the facts are in the accused favour, she can be persuaded to be less harsh on sentences.
Policeman la. But I still keep up to date with the Laws.
I also knocked someone down once, but at extremely slow speed, no visible injury. Got a stern warning. I was prepared for any charge except dangerous driving.
Now waiting for our beloved company to settle medical fees with the other party, although i did send him for check up.
Better approach sg father or son for help Liao.

Good afternoon JR !
I believe fine around 8K. Revoke around 8 Years if you cannot prove you are not negligent. I like to add. Life is at stake on the road. Please do your part to ensure no one is hurt! Everytime I hear people say whose fault by law. Knnn people can die ok. Just excercise more common sense and not go to hell. Just one example, passing a major junction straight when light is in your favour, 1)slow down to make sure no one from oncoming makes a right turn carelessly 2) if he makes a right turn is his fault, he should die. If your option is 2, I wish you burn in hell.
