Liverpool are waiting to hear from Fifa to see if their bid to sign Javier Mascherano will be successful.
The Reds are keen to sign the West Ham midfielder despite the fact the Argentine has already played for two clubs in the past 12 months.
Fifa rules permit any player turning out for more than two clubs over a one-year period between 1st July and 30th June the following year.
However, Benitez remains hopeful that Fifa will allow Liverpool to push through a move for Mascherano as he is not figuring at West Ham.
"He is a player we want but we are waiting for the answer," said Benitez.
"It's clear a professional must play, he cannot stay without playing any games.
"He can bring more balance to our team. I have confidence but we have to wait."
